1. Acceptance

By accessing or using gptimage.com (the "Service") you agree to these Terms of Use. If you do not agree, do not use the Service.

2. The Service

GPTimage is a free, anonymous web tool for turning text prompts into images via a third-party AI model. The Service is provided as-is for personal and commercial creative use, with no uptime guarantees.

3. Acceptable use

You agree NOT to use the Service to generate, request, or distribute content that:

• Is illegal in your jurisdiction or the jurisdiction where the Service operates.
• Sexualizes or depicts minors in any way.
• Impersonates a real person without their consent, or is intended to deceive or defame.
• Promotes violence, self-harm, hate, or harassment of individuals or groups.
• Infringes on third-party copyrights, trademarks, or other intellectual property rights.
• Attempts to bypass rate limits, reverse-engineer the Service, or interfere with the infrastructure that powers it.

We reserve the right to block IP addresses or otherwise restrict access if these terms are violated.

4. Ownership of generated images

Subject to applicable law and the upstream model provider's policies, you own the images you generate through GPTimage. We claim no copyright on outputs created by users. You are responsible for ensuring your prompts and the images they produce do not violate the rights of third parties.

Note that AI-generated images may not be eligible for copyright protection in some jurisdictions. Consult local law before relying on a generated image as the sole basis for an exclusivity claim.

5. No warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that the generated images will meet your requirements. Diffusion models are probabilistic and may produce unexpected, inaccurate, or unsafe outputs despite the safety filters in place.

6. Limitation of liability

To the maximum extent permitted by law, GPTimage and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service — including loss of profits, data, goodwill, or other intangible losses. Our total liability for any claim related to the Service is limited to the amount you paid us, which for a free service is zero.

7. Third-party services

Generation requests are processed by a third-party AI model provider, and analytics are handled by Google. Their respective terms and privacy policies apply to those interactions.

8. Changes

We may revise these terms at any time. Material changes will be reflected in the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.

9. Termination

We may suspend or terminate access to the Service at any time, for any reason, without notice. The sections of these terms that by their nature should survive termination (ownership, disclaimers, limitation of liability, governing law) will survive.

10. Governing law

These terms are governed by the laws of the jurisdiction where the Service's operator is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction unless local consumer protection law provides otherwise.
